Thiruvananthapuram: BJP state vice-president Shone George on Tuesday said the Supreme Court’s refusal to stay the restrictions imposed by Kerala high court on the functioning of the waqf board was a clear endorsement of the legal and administrative position raised by BJP.George, who had approached the high court challenging the legal validity of the waqf board’s constitution, said the apex court, while considering the appeal filed by the board, had only removed the reference in paragraph 6 of the high court order relating to supervision by the joint secretary. SC did not grant any relaxation in the other restrictions imposed on the board’s functioning, he said.George said the high court’s curbs on taking policy decisions, creating financial liabilities and utilising funds would continue. He had approached the high court pointing out that the Kerala State Waqf Board had been functioning without appointing the two non-Muslim members mandated under the Waqf Amendment Act.Supreme Court’s stand showed that courts would not protect institutions functioning in violation of the law, he said. Laws passed by Parliament are applicable uniformly across all states and political or ideological opposition cannot be a reason for non-compliance, George added.
