Times News NetworkKanpur: Shankar Nagdev, father of Jyoti, will file a review petition before the Supreme Court against the acquittal of Manisha Makhija. The Supreme Court had disposed of all the four appeals including three of the murder accused and upheld the verdict given by the Allahabad high court in the much-publicized Jyoti murder case of Kanpur. The Supreme Court had also confirmed the acquittal of Manisha Makhija who was initially held guilty by the trial court and later acquitted by the Allahabad high court.Talking to TOI, Shankar Nagdev said that he had filed a fourth appeal in the Apex Court against the verdict pronounced by the high court regarding acquittal of Manisha Makhija but the Apex Court dismissed the appeal and confirmed the high court’s verdict which had acquitted Manisha for want of evidence. He stated that the high court had returned the finding of acquittal of Manisha Makhija on the ground that mere evidence of prolonged telephonic conversations between Manisha and Piyush Shyamdasani neither conclusively established the allegation of affair or more importantly the participation of Manisha in the conspiracy to do away with the deceased.Further, the court had noted that Manisha was exploring prospects of marriage with other persons and therefore it could not be assumed that she was to benefit from the demise of the deceased in any manner. The Apex Court had observed in its order that it was not difficult to infer that Piyush and Manisha were to benefit from the removal of the obstacle that the deceased was. And the prosecution has satisfactorily explained this aspect of motive, Nagdev saidHe stated that in his opinion Manisha was the root cause of the case, therefore he would file a review in the Apex Court.
