Court dismisses bail applications of two accused charged in marksheet forgery case

Times News NetworkKanpur: Additional district and sessions judge, Kanpur Nagar, Nisha Srivastava on Friday dismissed the bail applications of two accused Manish Kumar and Raghav Sarraf charged in a forged educational certificate matter by the Beconganj police.Assistant district government counsel (ADGC) Vinod Tripathi said that Manish Kumar and Raghav Sarraf who are in jail are accused in forged certificate and marksheet case under Kidwai Nagar police station.The ADGC stated that accused Ziaul Hasan, Nooruddin and Hasan Asif, who had been arrested by the Beconganj police, during investigation revealed the names of Manish Kumar and Raghav Saraf.Raghav in his bail application claimed that his first bail application had been dismissed by the additional civil judge (Junior Division) on June 29 this year. The police arrested him and charged him under section 3 (5), 318 (4), 336 (3), 338, 340 (2) 61 (2) and 112 BNS. He was arrested by the Kidwai Nagar police on May 20, and since then he had been in district jail, Kanpur.In the Beconganj police station’s case, the accused pleaded that the police had neither arrested him from the spot nor recovered anything from his possession. He said that as he waS innocent and fabricated in the case, therefore he should be released on bail. Similar plea was made by accused Manish Kumar in his bail application.The ADGC opposing the bail application argued that the police had mentioned in the case diary that accused Ziaul Hasan, Nooruddin and Hasan Asif were arrested by the Beconganj police and they recovered 62 marksheets, migration certificates, provisional certificate, degrees and two laptops, one colour printer and seals of different universities and institutions from their possession. They had revealed the names of Manish Kumar and Raghav Sarraf who had been arrested earlier.The ADGC said that the accused belong to a gang involved in a fake and forged marksheet racket and this was the second FIR lodged against them. Investigation against them is going on in several cities of the country. If bail is granted to the accused there is all possibilities that they would destroy the evidence and jump the bail.The judge, after hearing the arguments and going through the evidence on record, dismissed the bail applications of Manish Kumar and Raghav Sarraf.
